General terms and conditions

The following terms and conditions apply to this offer (“Offer”) of equipment, accessories and any accompanying services (collectively “Products”) by Girandolone to any potential or actual purchaser (“Purchaser”) of Products. By accepting this offer for Products, Purchaser agrees to be legally bound by the following terms (“Terms”):

The Rental of Products and / or Services is reserved only to eligible customers ( customers aged 18 and over) as "consumers" under the Consumption Code (the "Customers" and, together with the Seller, the "Parties")
By subscribing to these General Conditions, the Customer declares to be informed of all necessary pre-contractual information
Accepting the following Terms and Conditions involves a valid and binding contract between the Seller and the Customer with legal effects concerning the rental of all Products and / or services and any shipping services selected by the Customer as stated in the written order
Customers are entitled to exercise the right of withdrawal according to the terms
Upon acceptance,  a copy of these terms and conditions along with an invoice will be sent by e-mail to the Customer
Please refer to the Civil Code for anything which is not specified in the General Terms and Conditions in regard to rented products


1. PRODUCTS AND PRICES

The Seller declares that the images of all the products available on the website www.Girandolone.com ae purely for illustrative purposes.

The Seller nevertheless ensures that the characteristics of such products - unless amended by the producer are indicated next to the product itself – any amendment will be promptly communicated to the customer before the order is shipped.  The prices are all inclusive of VAT and do not include shipping costs. For more details on shipping costs, see the next section. Girandolone does not charge  any other costs not expressed in the order form.


2.  ORDER PROCESSING AND SHIPPING

Products rented are delivered to the address chosen by the consumer (home and/or hotels and/or residence)

In case of hotel or residence, the Products are delivered to the hotel reception. If it’s not possible, products are delivered by appointment to the Customer or a person on his behalf. The appointment is defined as soon as the order is complete, typically in a two-hour span and at least 48 hours before the delivery date.

In case the Products could not be delivered to the Customer or to a person on his behalf Girandolone will try to set a new delivery date with the Customer. The customer would be in charge of any added cost.

The shipping package indicated the date of the confirmation of the order.

Shipping is generally carried within 48 hours from the order confirmation, festive days and bank holiday excluded, and in accordance with the logistic company.

Delivery times by carriers and shipping costs are stated in the rental order. The carriers cost may vary according to the place of delivery  as well as a products weight and volume.


3. PAYMENT AND DEPOSIT FOR RENTAL SERVICE

The Customer may pay the deposit either by bank transfer or by cash at the delivery.

A deposit is required for the rented goods. It will be returned to the Customer after verifying the goods are in perfect conditions.

In the case of payment by bank transfer, the deposit must be paid within 48 hours before the date of delivery. In case of non-payment Girandolone reserves the right to consider the order null and will not deliver the products. Girandolone reserves the right to claim compensation for any damages.

In case of payment by cash on delivery the rental deposit will increase of 10%.

In case of shipment the only accepted payment method is by bank transfer. The product will be shipped after receiving the transfer.

Girandolone reserves the right to seek compensation for the entire price of the products in case of theft or irreparable damage.


4. RIGHT OF WITHDRAWAL AND RETURN OBLIGATION

In case of withdrawal, as under the law no. 206/2006 (Consumer Code),the Customer is bound to to notify the Seller within 14 days from the end of the contract by a registered letter with advice of delivery.

It is understood that, in the event of withdrawal, the Seller is now committed to refund the Customer, including the delivery costs. These refunds will be paid by bank transfer to the account indicated by the Customer.

Products must be returned to the Seller's premises no later than 14 days after receipt of the notice of withdrawal. The Returns of the Products will be the charged to the Customer.

For the withdrawal to be validly exercised, the Products must be returned undamaged and with their original packaging. If the above conditions are met, the Seller will refund the sums paid by the Customer without delay and not later than 14 days after the return of the Products.


5. RENTAL SERVICE: TERMS OF USE AND PRODUCT RETURN

The Customer is required to maintain and preserve the hired product.

At the end of the period specified in the order, the customer agrees to return the rented product under the same condition as it was originally delivered, except the normal deterioration resulting from use.

The Product must be returned to the Seller's premises within the due time or within a time extended by the Seller. In the event of a delay in the delivery of the Product, the Customer shall pay the seller a penalty of Euro 5,00 for each day of delay.

Any costs of delivery of the product will be included in the quote at the Customer's expense.

Except as indicated in art. 3, within 10 days from the return of the Product, the Seller has the obligation to report to the Customer any damage and / or malfunction of the Product from inappropriate use, charging the customer for the  repair costs.
On rental products, in the event of the loss of a product, the Customer will have to compensate Girandolone for the damage. Upon receipt of the product, Girandolone will verify the status of the product and, in case of damage, the Customer will be contacted for a compensation.


6. WARRANTY

All products are under warranty of the respective manufacturer, as under the Legislative Decree no. 206/2006 (Consumer Code).


7. COMMUNICATIONS

Any communication directed to the Seller must be sent to the following contact: info@Girandolone.com.

Customer agrees to receive by Email (and / or other electronic format) any communication coming from Girandolone.


8. APPLICABLE LAW

The contract is governed by Italian law.


9. CONCILIATION

The Parties shall settle disputes related to this Agreement with the conciliation service of the Arbitration Chamber of Ascoli Piceno.

I claim to have received full information on any contractual interest in accordance with applicable regulatory provisions, under art. 1341.
